Terms & Conditions

Change of date/time
The Photographer must be notified immediately of any changes in schedule. Notification of any changes can be made by phone along with written notice sent via email for documentation. If an email is sent, a confirmation of receipt must be sent back by the Photographer in writing or via email. The Photographer will make every effort to contact the Client, but it is the Client’s responsibility to contact the Photographer to confirm all events and times. 

Cancellation and payment

£35 SESSION FEE IS TAKEN AT BOOKING. This secures your session. 
 If you need to cancel, please let me know as soon as possible so I can reschedule with you. If you do not wish to reschedule, full refund can be given at my discretion, as long as at least one months notice is given!
Packages for digital files are available after your session and can be purchased directly through your online gallery. Downloads can then be made directly through your gallery. 

Bronze £199 – Five Digital Files 
Silver £299 – Ten Digital Files
Gold £499 – All Digital Files

Once digital files are downloaded, no refund shall be given UNDER ANY CIRCUMSTANCES.

Online Gallery will be live for 24 hours from release. Please ensure you choose your chosen package within this time.

Failure to Perform
The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. If your child is having a bad day, I will work with you all as best as possible, but being a mum myself I can totally relate and we can have a re-shoot if I deem this necessary.

Turnaround and Timescales
I aim to have clients gallery ready to view online within 1-2 weeks of your shoot. In busy periods this may increase, but I will advise you if this is the case. 

Products – Prints ordered through online gallery will be mailed directly to your address. Wall arts and albums will be ready for collection/courier to client within 4 weeks. Any damage must be reported to photographer immediately upon receipt so a replacement can be organised. 

Expenses
Clients are responsible for all location fees and permits (entry to Zoo’s, farms, etc). Not applicable to sessions held in Kent. All fees will be discussed and confirmed with client beforehand. 


Garments

The Photographer cannot be held responsible for damage to client garments due to environmental or creative events. 

Creative License
Images are edited at the Photographer’s discretion, and delivered images may not include all images shot. The Photographer reserves the creative rights to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards. Once the images are released to the client, there shall be no refunds made at all. Changes to black & white or colour will be made at photographers disruption, but a MAXIMUM of three images. Images are edited to photographers style and artistic eye. 

Force Majeure
If the Photographer or its assigns cannot perform this Agreement due to a fire, casualty, strike or other civil disturbances, Acts of God, including but not limited to, road closures, severe traffic, fire, terrorism or other causes beyond the control of the parties, then the Photographer shall return any moneys paid by the Client, but shall have no further liability with respect to the Agreement. This limitation of liability shall also apply in the event that photographic materials are damaged, lost through camera malfunction, compact flash card malfunction, or otherwise lost or damaged without the fault on the part of the Photographer. The limit of liability for a partial loss of originals shall be a prorated amount of the exposures lost based on the percentage of total number of originals.

Cost of Portrait Photography

– £35 session fee taken on booking. This includes no images, it is purely for my time capturing and creating your gallery/film.

– Once your gallery is released you have 24 hours to choose your collection. Bronze, Silver or Gold. 

– Client can upgrade collection at  any time. We do not accept downgrade. 

Client is under no obligation to purchase anything additional if they do not wish. If client is not happy with final gallery, full refund is made and gallery destroyed. If digital files have been released, no refund shall be made under any circumstances. 

Copyright
The Photographer retains the copyright to all images produced by the Photographer. The client understands the images given cannot be used for profit or advertising and all posting of images on the internet must be acknowledged as images by the Photographer. 

Corona Virus
Social distancing must be maintained at all times. Client understands the guidelines set out by the Government at this time. If you have been unwell, please cancel your session! We can reschedule. 

GDPR
New Government legislation has been released in May 2018 stating that the public should have the right to know what information (data) is held on them by any company and where that data is being stored. The general public have the right to have all date held on them removed at any time. 

Here at Hannah Dougal Film & Photography we take your personal data protection very seriously. Your information is taken and stored on 17 Hats, this is an online client database system which is password protected and GDPR compliant. Peoples with access to this information include myself, and my personal assistant Emma Flint. You will not be contacted with promotional material unless you give express permission. A contract will be sent following your viewing session asking your wishes in regards to your images and film. Nothing is shared unless express consent is gained.

If you would like to see the information held on you at any time, please email us and we can send you a link to your own private client portal. Here you can delete, view and change any of the information stored. 

For images taken (this is also classed as personal data and is there fore protected under these new guidelines) they are stored on my password protected Mac and hard drives for three months after your session. Following this time, unless I am given express permission, they will be destroyed. 

Images sent to labs for product creation will be GDPR compliant and the data protected. Please note that some of the professional print labs used are outside the UK.

This is a contract for personal photography services to be provided by the Photographer.
